We are committed to safeguarding and preserving the privacy of our community. This privacy notice explains what happens to any personal data that you, as a member of the Skylark Works community, share with us. It also informs you of your privacy rights and how the law may protect you.

The data we may hold about you.
We may hold the following information about you:

  • Personal details such as your name 

  • Contact details such as your email address and phone number 

  • For client service providers, information about your identity so we can complete due diligence and right to work checks 

  • For investors and financial sponsors, information about your identity so we can complete due diligence, KYC and AML checks 

Why we use this data.
UK data protection laws say we need to have a lawful basis for using your personal data. At least one of the following must apply: 

  • Contractual or legal duty

  • Legitimate interest

  • Public interest

  • Vital individual interest

  • Consent

At Skylark Works, we use personal information for the following reasons:

  • Contractual or legal duty: To check the identity of client service providers, investors and financial sponsors, complete due diligence/KYC/AML checks to prevent financial crime and communicate ongoing re our services

  • Legitimate interest: To communicate with you in a relevant way about Skylark Works, for example community updates, services, client support etc.

Who we share your data with.
We only share your information if it is required to complete a service, for example Know Your Customer (KYC) service providers that help us with identity verification or fraud checks. 

We may also share your information for the purposes of law enforcement. This may include sharing your details with:

  • Authorities that prevent financial crime, money laundering, terrorism and tax evasion if the law says we have to, or if it’s necessary for other reasons

  • The police, courts or dispute resolution bodies if required

  • Any other third parties where necessary to meet our legal obligations

How we store your data.
In operating our website and our services it may become necessary to transfer data that we collect from you to locations outside of the European Economic Area (EEA), such as the US and Australia, for processing and storing. By providing your personal data to us, you agree to this transfer, processing or storing. This may involve the transfer of data by electronic media, including the internet.

There is no adequacy decision by the European Commission in respect of the US or Australia which means that the laws of these countries are not deemed to provide an adequate level of protection to your personal data. However, to ensure that your personal data receives an adequate level of protection we may implement any mechanism that is approved under data protection laws to ensure that your personal data is treated by those third parties in a way that is consistent with EU and UK laws on data protection. These measures could include an EU-US Privacy Shield and/or EU standard contractual clauses.

How long we keep your data.
We keep most of your data for as long as you’re a part of our community. Otherwise, we keep data for the period reasonably required for us to use it in accordance with this policy or to comply with our legal obligations. 

To work out how long we keep different categories of data, we consider why we hold it, how sensitive it is, how long the law says we need to keep it for, and what the risks are.

Your rights.
You have a right to:

  • Access: You have the right to access your personal data and obtain a copy of it

  • Rectification: You can correct incomplete or inaccurate data we hold about you

  • Erasure: You can ask us to erase the personal data we hold about you

  • Restrict: You can ask us to restrict our handling of your personal data

  • Portability: You can ask us to transfer your personal data to a third party

  • Object: You can object to how we are using your personal data

  • Complain: You always have the right to lodge a complaint with us or the Information Commissioner’s Office, the supervisory authority for data protection issues in England and Wales

How to make a complaint.
If you would like to make a complaint about how we use your personal information, please reach out to our Managing Director, Katy Brown. We will do our very best to resolve any problems. 

If you’re not happy with our response, you can refer your complaint to a data protection supervisory authority. The UK’s supervisory authority is the Information Commissioner’s Office (ICO). For more details, you can visit their website.
